These terms govern your use of apiplant.com and the purchase of managed website hosting and related website services from APIPLANT LTD.

These Terms and Conditions govern your access to our website and any order for website design, delivery, or hosting services placed with APIPLANT LTD. By using this website or purchasing services, you agree to these terms.

1. Services

We provide software development, website delivery, and managed hosting services. Service scope is defined by the applicable page, proposal, or written agreement. We may update, improve, or replace parts of the service where this does not materially reduce what you purchased.

2. Orders and onboarding

You must provide accurate contact, billing, and project information. We may request content, DNS access, domain settings, or technical credentials to complete delivery. Delays in providing required access or materials may delay launch dates.

3. Subscription pricing and billing

Our standard managed website hosting is priced at EUR 29/month per website unless a custom agreement says otherwise. Paid hosting subscriptions are billed in advance through Paddle, which acts as merchant of record. Applicable taxes are calculated at checkout.

4. Automatic renewal and cancellation

Hosting subscriptions renew automatically each month until cancelled. You may cancel at any time by emailing us or by using Paddle account tools when provided. Cancellation takes effect at the end of the current paid billing period, and previously paid fees are not prorated outside the refund window described below.

5. Refunds

We offer a 14-day money-back guarantee on eligible hosting payments. Please review our Refund Policy for the full rules, exclusions, and request process.

6. Customer responsibilities

  • You remain responsible for the legality of your website content.
  • You must keep any credentials you control secure and notify us promptly of suspected compromise.
  • You must not use the service for spam, phishing, malware, copyright infringement, unlawful content, or abusive traffic.
  • You should keep your own copy of source files, media, and business records even where backups are provided by us.

7. Third-party services

Domain registration, external SaaS products, premium plugins, paid email delivery, and other third-party tools may be required for some projects. Unless expressly included, those costs are separate and are governed by the third party's own terms.

8. Availability and support

We aim to keep hosted sites available and secure using commercially reasonable efforts, but no service is guaranteed to be uninterrupted or error-free. Planned maintenance, upstream outages, force majeure, and third-party failures can affect availability.

9. Intellectual property

You retain ownership of your content, branding, and materials. We retain ownership of our pre-existing tools, frameworks, and know-how. Unless otherwise agreed in writing, you receive the rights necessary to use the delivered website and hosting service for your business.

10. Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages. Our total liability arising from the service is limited to the fees paid by you to us in the 12 months preceding the claim.

11. Governing law

These terms are governed by the laws of Cyprus. Disputes are subject to the competent courts of Cyprus, without prejudice to mandatory consumer protections that apply in your country of residence.
